How to Buy Property in Malaysia: The Step-by-Step Process (2026)

The short version

  • Seven steps: shortlist → book → SPA + lawyer → state consent → loan → stamp duty + transfer → keys.
  • You can buy remotely, through a lawyer (and a power of attorney if needed).
  • For international buyers, state consent is the step that adds time.
  • Two timelines: a completed (subsale) home runs ~3–6 months; a new launch runs on the developer’s build schedule.

The seven steps

  1. Shortlist a property that clears your state’s minimum price.
  2. Book — pay the deposit (an EOI, Expression of Interest, or a booking form).
  3. SPA + lawyer. Sign the SPA (Sale and Purchase Agreement) and appoint a lawyer (not optional).
  4. State consent (Section 433B, National Land Code) — the state’s approval to transfer property to an international buyer. This adds weeks to months.
  5. Loan, if you’re financing.
  6. Stamp duty + transfer — the MOT (Memorandum of Transfer) is executed and duties are paid.
  7. Completion — keys for a completed home, or vacant possession when a new launch finishes.

Two timelines

  • Subsale (completed home): roughly 3–6 months from SPA to completion.
  • New launch (under construction): runs on the developer’s build timeline — often a few years to vacant possession.

Buying from abroad

You don’t need to be in Malaysia. A lawyer — and, if needed, someone acting under a power of attorney — handles the SPA and transfer. A trusted local agent keeps the paperwork moving and the deal on track.
