The home that suits you now may not be the home you need later. Family might visit more often, or you may want a different neighbourhood. If the property is the residence required under federal MM2H, its sale condition matters to that future plan. There is an upgrade exception for a higher-value residence, but the programme procedure needs to be settled before either transaction.
In this guide
The condition follows the home bought for the programme
- Under the current federal MM2H programme, an approved participant must buy and own a qualifying home.
- The programme generally restricts sale of that residence for 10 years, with an exception to upgrade to a higher-value home.
- This condition concerns the qualifying programme residence; it should not be applied automatically to every home a participant owns.
- The MM2H price floor does not replace state foreign-purchase rules or consent for the actual unit.
Choosing a home for an MM2H plan?
Tell me which category you are considering and where you hope to live. I can help compare possible homes; your licensed operator and lawyer can explain how the programme and property rules apply.
Which home carries the sale condition?
MOTAC’s current federal programme materials require a home purchase after MM2H approval. They say the participant generally cannot sell that residence during the first 10 years, unless upgrading by buying a residence of higher value. Here, “MM2H residence” means the home bought to meet that programme requirement.
That definition matters if you owned another home earlier, bought a home under a different approval, or joined a separate state programme. The terms may not be the same. Ask the licensed operator how the home you are considering is linked to your approval letter, and keep the explanation in writing.
Before committing to the required home
- Check the approval route. Confirm whether your application is federal MM2H or a separate state scheme, and whether older approval terms apply.
- Check the exact unit. Have your conveyancing lawyer review the title, buyer name, property type, state minimum price and any consent.
- Check both price tests. A federal MM2H category price and a state foreign-buyer threshold are separate tests. Meeting one does not prove the other.
- Check the seller and route. SEZ/SFZ terms require a qualifying direct developer purchase; do not assume a subsale is eligible.
- Check the cash plan. Get a written schedule for deposit, SPA, loan drawdown and other costs. Treat FD withdrawal as conditional until OSC MM2H and your bank confirm eligibility, timing and documents.
If you might sell or upgrade later
If your household needs a different home later, MOTAC allows an upgrade exception when the replacement residence is worth more than the current qualifying home.
The public wording leaves practical questions open: how value is established, how the replacement must be purchased, and when sale approval is needed. Before listing or signing either transaction, ask OSC MM2H and your licensed operator to explain the procedure for your approval. A higher asking price alone does not show that the condition is met.
The pass may be affected if the condition is not met. Your lawyer should separately handle the ordinary sale, transfer, state-consent and tax steps.
Is the programme federal or state-run?
If your plan is in Sarawak, keep its S-MM2H route separate. It is a state programme, and its current guidelines say property purchase is optional; any Sarawak purchase remains subject to state land rules.
Do not carry the federal 10-year restriction across to S-MM2H unless a term in the participant’s own current approval requires it. Sabah land acquisition and title matters need Sabah-specific confirmation too.
Keep the immigration pass, the property and your tax residence as separate parts of the decision. Owning or buying a home does not itself grant immigration approval or determine tax residence.

Confirm current requirements with the relevant authority, licensed operator, bank or Malaysian lawyer for your case. Property shortlisting does not confirm immigration or legal eligibility.
