A landed home may look right for your family, but its appearance does not settle whether a foreign buyer can acquire it. Sometimes the answer is yes. The title may be individual or strata, and the land category and registered restrictions matter too. Start with the actual lot and proposed buyer before paying.
If you have a state or property in mind, send me the link. I can gather the title and project details for your solicitor.
What does the title say about the home?
You may picture a garden or a house style first. On paper, the purchase could still be a completed house, a vacant bungalow lot, a landed-strata unit or another interest. The title or strata-parcel details, land and property category, restrictions, district and buyer name tell your lawyer which route applies. A land lot does not include a future house unless the contract says it does.
For a property in Peninsular Malaysia, section 433B of the National Land Code provides for State Authority approval for relevant acquisitions by non-citizens and foreign companies. Sabah and Sarawak have separate land laws, and state acquisition conditions and price thresholds differ.
How the state and title change the answer
- Selangor: PTG publishes the section 433B approval route. Its public materials distinguish strata property from individual-title landed property. The RM2m reference in a 2021 special programme applies to specified individual-title landed forms; do not apply it to every house or treat it as a current blanket rule without checking the unit and programme.
- Johor: PTG lists eligible foreign-interest residential categories, including specified two-storey-and-above homes, and excludes one-storey and one-and-a-half-storey terrace homes. Quota, state consent and other restrictions still matter.
- Other states: Use the current land-office circular for the exact district and property class. Perak PTG lists a new 2026 foreign-acquisition guideline, so older summaries may be stale.
Even with a larger budget, the title and approval still need to fit the purchase. A company purchase brings its own ownership, control, tax and state-consent questions, so have a lawyer look at that structure separately.
A bungalow lot and agricultural land follow different routes
A residential bungalow lot and agricultural-category land are not interchangeable. Johor’s official guidance says foreign interests cannot directly own agricultural property under its general route.
A lease may be considered for specified commercial agriculture using modern technology, agro-tourism, or agriculture-based export projects. The published conditions include a lease of at least 10 years, registration under a local company, and a stated value or acreage test. This narrow route is not permission for a foreign individual to buy a hobby farm. Other states may apply different rules, so have a lawyer confirm the exact land category and current state policy.
For Penang, the PTG guideline updated 1 August 2024 says a non-citizen or foreign company may resell building-category property only after three years from the SPA date. This is a state-specific condition; ask your solicitor to check how it currently applies to the selected unit.
Before you put down a booking payment
- Get the title/parcel details and confirm the actual buyer.
- Ask the solicitor to verify state threshold, category, restrictions and approvals.
- Get written confirmation of any quota release or special route and the unit it covers.
- Read the booking and SPA conditions, including approval failure and refund terms.
For the state price overview, use the minimum-price guide and the state-consent guide to follow up on the location and approval questions.
General information only, not legal advice or a statement that any lot qualifies. Confirm the title, proposed buyer and current rule with the relevant authority and your solicitor.
