Can a Foreigner Buy an Under-Construction or New Launch Unit?

You are foreign and the unit you like is a new launch — not built yet, still a showroom and a floor plan. Can you even buy it? Or is that only for finished units you can walk into?

Here’s my read: yes, a foreigner can usually buy a new launch, and often it is the easier path, not the harder one. But “easier to buy” is not the same as “nothing to check.”

Why new launches are often smoother for foreigners

When you buy straight from the developer, the developer usually handles the state consent paperwork (the government’s yes that lets a foreigner’s name onto the title) as part of the sale. Many projects have already sorted out which units foreigners are allowed to take. So a lot of the friction is done for you before you sign.

You still have to clear the same gate every foreign buyer clears: the minimum price a foreigner must pay in that state. That floor is set per state and it changes from time to time — see my minimum price guide for the state-by-state breakdown.

What to check before you commit

  • You are buying a promise, not a finished unit. Look at the developer’s track record — have they delivered past projects on time and to spec?
  • You pay in stages as it gets built (progress payments), not all at once. Make sure your financing lines up with that schedule.
  • Not every unit is open to foreigners. Some are held back (for example, lots reserved under bumiputera quota). Confirm the specific unit is one a foreigner can take.
  • Consent still has to come through. The developer usually drives it, but it is the step that puts your name on the title — don’t treat it as a formality.
